The Insurance company is putting me partially at fault for the car accident! | Insurance Tactics
Insurance Company: “Well we think you are partially at fault!”
You: “Are you out of your mind🤯?”
Yes, Insurance companies love to use the tactic of putting you partially at fault for a car accident when you are not. In the legal world, they will say you have “Comparative Fault” for the accident.
How frustrating right?
When Insurance companies do this, they are able to SAVE MONEY💲 which is their primary goal.
For example, maybe someone pulled out in front of you, but the insurance company claims you were driving “over the speed limit” so they are placing you 20% at fault. When this happens, they are only going to pay for 80% of your damages, so if it cost $10,000 to fix your car, they are only going to give you $8000 and you are stuck with having to come up with the rest yourself or use your insurance if you have the appropriate coverage.
So what do you do? How can you FIGHT BACK 🥊?
Unfortunately the options aren’t the best.
If you only have a Property claim, you are very close to a no win situation because the only thing you can do is sue the insurance company, and most Law Firms will not sure an Insurance company for Property only claims, especially not for a couple thousand dollars. The time, money, and effort that goes into filing a lawsuit is just not worth it at the end of the day.
NOW, if you do have injuries, this is your best hope to fight back because now you can get a Law Firm to file a lawsuit on your injury claim and because they are doing that, they will throw the property in as well.
That is your best option but other than that, you can file a complaint with the Texas Department of Insurance, but I can assure you, it is very unlikely for anything to happen.
