LAWYER DROPS CASE AFTER CAR CATCHES ON FIRE BUT WE SIGN IT AND SETTLE IT! AMAZING STORY OF FINDING INSURANCE FOR A TEXAS CAR ACCIDENT!
In over 10 years of working in this industry I would say this is the most exciting case I have ever worked on!
This case came across my desk having already been dropped by another Lawyer and rejected my many others. Usually that is a strong indication that there is no pathway forward, but I am the type to always flip over every stone possible before believing it.
In this specific case the car accident victim’s vehicle was rear ended which caused the vehicle to lose control, veer off the road, hit a tree and ultimately catch on fire. The car accident victim was seriously injured with broken bones and over half a million dollars in medical bills.
Now once its determined who is at fault for the accident, the next step is to see if there is available auto insurance to file a car accident claim. Here is the timeline and steps I took to find auto insurance:
- The at fault driver told the Police he did not have auto insurance.
- The Police ran the vehicle information in their database and confirmed there was no auto insurance.
- I asked the car accident victim to have his insurance company send me a copy of his declaration page to see if he had protection against uninsured drivers. I spoke to his insurance agent and viewed the declaration page, along with his rejection forms that stated he agreed not to have uninsured motorist coverage, and it was confirmed he did not have protection against drivers without insurance.
- We hired an outside research company to see if they could find any available insurance for the at fault driver or the vehicle he was in. The research company told me they found insurance for the vehicle. This research company has been wrong in the past so I needed to see it through.
- I called the insurance company the research company gave me and they told me they did not have the vehicle or driver as a policy holder in their system. However, they told me there was another name associated with the driver but that it was a different last name and the vehicle was not on the policy.
- I did further research to see who I could find connected with the at fault driver and determined his mother was the vehicle owner. The interesting aspect of this though is the mother was recently married and had just moved to Texas a month before the accident. Because of the recent name change and move I believe that is why it did not come up in the police system or insurance company system at first.
- The insurance company told me I could file a claim but that it would likely be denied because the vehicle is not on the policy. I told them I wanted to file the claim anyway which would force them to look a little closer before sending me a denial letter.
- Several days later I got a call from the insurance company stating there was insurance! What I believe happened was because the vehicle owner had just moved and changed her name, some things got crossed at the insurance company which delayed the policy from being fully updated right away.
I was extremely thankful that this victim now had a pathway forward in his case and he ultimately received the full policy limits from the insurance company. To make this case even better, the other driver’s policy was not minimum limits so the car accident victim was able to walk away with a great settlement and got all of his medical bills taken care of.
It is cases like this that really make it awesome to do this job.
