LAW FIRM DROPS CASE AND ANOTHER SETTLES IT FOR POLICY LIMITS! | CAR ACCIDENT EXPERT RESPONDS⚖️🚗
I have lost count with how many times I have signed up a case that another Law Firm has dropped because they didn’t think there was a pathway forward.
I mean it’s great for the Law Firm that settles the case but it really frustrates me when a Law Firm doesn’t do the best they can for their client.
You see, some car accident cases are not clear cut and they take a good amount of investigation for them to be successful. What I have seen in my experience, is many Law Firm’s will look at the accident report or hear the insurance company denied liability and immediately drop the case. This discourages the client greatly because now they don’t think they have a case.
In this video, I talk about a case I have worked on where another Law Firm did exactly this.
It was 4 months after the accident when the accident victim called me.
She let me know her case was dropped by a Law Firm but she didn’t believe she was at fault.
I am the type to flip over as many stones as possible when reviewing a case. She first told me the police put her at fault. She then told me the vehicle who rear ended her hasn’t called her back. She further stated that her own insurance only gave her $500 for her totaled vehicle when it’s worth about $4000.
I called the Law Firm that dropped her case and requested her entire file. The Law Firm sent me back the accident report and their drop letter. When I confronted them with how they could only have two pieces of documentation after 4 months, they got nasty with me and basically told me to stop contacting them. Nice.
I should put their name here but I wont.
I asked the car accident victim to send me some photos. Based on the photos, it should she was hit dead center in a rear end accident. This did not match up with the accident report because the Officer stated she merged into a lane while being impacted. This would have caused back left or right fender damage, but never dead center contact.
This was my first indication that there may be a case.
I then spoke to the at fault driver’s insurance and was told there actually was no insurance on the policy because they closed the policy before the accident occurred. This was very unfortunate because I now had a case that may have potential but not if there is no insurance to go after.
I called the accident vicitim and asked her to get her declaration page so I can review the coverages she has on her policy. I told her if she has Under / Uninsured Motorist (UM/UIM) Coverage she may still have a case. Thankfully, she did!
I then contacted her insurance company and opened up a UM/UIM claim. A UM/UIM claim allows an accident victim to pursue their own policy if they are hit by a driver with no insurance. However, I still needed to wait and see if her insurance was going to accept she was not at fault for the accident and accept the claim.
Her insurance company is known in the industry for not operating in a timely fashion so we waited a couple months before finally getting confirmation that they will accept the claim!
The accident victim already had shoulder surgery because of this accident so the insurance company is going to extend their full policy limits.
It really is amazing.
Here we have an accident victim that was signed up by a Law Firm, reviewed for 4 months and then dropped. She didn’t know what to do. I was able to finally talk with her and after several months of investigation she is going to get a settlement.
