Is the Insurance company denying your claim because the driver was not the owner of the vehicle? | Car Accident Terms

Our Car Accident Term today is “OWNER”🚘

This term is used in the car accident industry when:

1. The person who caused the accident is not the owner of the insurance policy and so the insurance company will tell the accident claimant that they need to talk to their insured before making a decision on liability for the accident.

2. The person who was hurt in the accident is different than the vehicle owner of the vehicle they were hurt in and so the insurance company will state they are only going to discuss property damage related matters with the “vehicle owner”.

3. The person who caused the accident is an employee of a company and the insurance company will state they need to talk to the owner of the company and/or contact for the company to discuss claim matters.

At the end of the day, the insurance company is not to be trusted. We have many cases where someone causes an accident with our client and they are not the vehicle owner. The insurance company will try to do everything possible to deny the claim saying things like “We may or are going to deny because the driver is not the owner”. This is not a valid reason to deny a claim. As long as the person had permission to drive the vehicle and is not an excluded driver in anyway, there should be coverage for the accident.
