Did someone WITNESS your car accident? Did you get their statement? 👀

WITNESSES can be extremely helpful when it comes to car accidents, especially car accidents where liability is disputed. That said, they are meaningless if you don’t actually have their information and statement.

The hope is, the Police Officer puts the WITNESS on the accident report, but that does not always happen. In fact, most of the time it does not happen and then it becomes the duty of the person in the accident or the Law Firm representing them to get the WITNESSES statement.

I am working a case right now where the other driver is stating they were not at fault for the accident but there was a WITNESS at the scene who stated otherwise. However, the Police Officer never took the WITNESS’ statement and then put our client at fault. We had to track down the Police Officer and his Body Worn Camera to see what happened. Sure enough, there the WITNESS was, but the Officer ignored him and went back to his vehicle to finalize the report.

The goal now is to get a NOTARIZED WITNESS AFFIDAVIT which is basically the WITNESS giving their statement under oath which means if the case goes to court later, it can be introduced as evidence. If you only have a statement from the WITNESS it may be enough but if go to court you will need a notarized affidavit.
