What is a CONTRACT in a car accident case?

Typically you will hear the word “Contract” while consulting with a Lawyer.

This “Contract” is an agreement between YOU and the Law Firm to represent you for your car accident case. Most of the time this is a contract limited to the Bodily Injury Claim only. Property damage is handled by YOU directly but most good Law Firms will help you navigate that part of the case free of charge.

At least in Texas, Law Firms charge for their services off of a contingency fee which means YOU DONT PAY OUT OF YOUR POCKET. It means, the Law Firm CAN ONLY get paid through the case, regardless of how the case goes. This is a great comfort to car accident victims who are worried about having to come up with money for a Lawyer.

Typically the contingency fee breaks down like this:

1. If a settlement is reached, Lawyers are paid 33.3%
2. If a law suit has to be filed, Lawyers are paid 40%
3. If the case goes to trial, Lawyers are paid 45%

To some, that may seem like a lot of money but if you get involved with a GOOD LAWYER, even with their percentage coming out, you will walk away with more treatment and money in your pocket than you ever would on your own. There is a much longer conversation to have surrounding WHY, but in a nutshell, there are a lot of categories of compensation you can get compensated for and the good Lawyer knows how to squeeze every penny, while the Insurance companies are on the other side trying to save every penny.
